The Foundation has filed an amicus brief in two Public Employment Relations Board (“PERB”) cases. The brief addressed the question of whether PERB could exercise jurisdiction where a charter school has a management agreement with a private for-profit company to operate the school. The Foundation argued that the National Labor Relations Act preempted PERB from acting, and, under state law, PERB also lacked jurisdiction where a private entity is a joint employer with a “public” employer.
