Roger S. Kaplan is a member of the firm of Jackson, Lewis, Schnitzler & Krupman. He is leader of its substance abuse testing practice group and co-leader of the firm’s occupational safety and health practice group.
Mr. Kaplan has represented clients and appeared before executive departments and administrative agencies, such as the United States Department of Labor (Occupational Safety and Health Administration), the Occupational Safety and Health Review Commission, the National Labor Relations Board, and the Equal Employment Opportunity Commission. On behalf of a client association, he participated in negotiations with OSHA’s national office concerning implementation of a crane safety standard. He also has appeared before many federal and state courts, including the United States Supreme Court.
As leader of the substance abuse testing practice group, Mr. Kaplan has worked with many employers to help assure that their drug and abuse testing policies and procedures comply with the state and federal laws. He has worked with employers throughout the United States to develop effective testing strategies, policies and procedures.
Mr. Kaplan has addressed business and professional organizations on a variety of substance abuse and occupational safety and health law topics, including Department of Transportation and other federal and state regulation of employee substance abuse testing, fatality and catastrophic accident prevention and management, the handling of OSHA inspections, hazard communication rules and right-to-know laws, powered industrial truck operator training, controlling workplace violence, ergonomics, bloodborne pathogens, the criminalization of OSHA, liability of safety professionals, and the impact of the Americans With Disabilities Act on OSHA and workers compensation laws.
Among the conferences and organizations Mr. Kaplan has addressed are the Mid-Atlantic Region Safety and Health Expo, sponsored by the Occupational Safety and Health Administration and the New Jersey State Safety Council, the New Jersey Occupational Safety and Health Conference, the Long Island Chapter, the Society for Human Resource Management, the Connecticut Business and Industry Association, the New York Chapter, American Corporate Counsel Association, the New York State Health Facilities Association, and the CCH Incorporated/Jackson Lewis Symposium.
Mr. Kaplan is a member of the Editorial Advisory Board of the OSHA Guide for Health Care Facilities, published by Thompson Publishing Corp. He also authored “The ADA’s Impact On The Occupational Safety and Health Act, in Lotito, Soltis & Pimentel, “The Americans With Disabilities Act: A Comprehensive Guide to Title” (1992). He co-authored the Matthew Bender Company “Business Law Monograph” entitled Responding to Union Organizing Drives (1986-present), and other works. He has edited the CCH Shared Learning module on substance abuse testing. Mr. Kaplan also coordinates the editing and updates for the Ceridian HR Comply State Compliance Manuals. He is a past contributor to the American Bar Association’s Committee on Labor Law publications, The Developing Labor Law.
Mr. Kaplan received his B.S. degree from Cornell University, School of Industrial and Labor Relations. He holds an LL.B. degree and an LL.M. degree from New York University School of Law. He is a member of the bar of the State of New York.
