ALF Advisory Council Member Nancie Marzulla Discusses Tyler v. Hennepin County on Federalist Society Webinar

Last month, as the Supreme Court heard oral arguments in Tyler v. Hennepin County, ALF’s Advisory Council member Nancie Marzulla was invited to discuss this case of “Home Equity Theft” on the Federalist Society’s program, Courthouse Steps Preview: Tyler v. Hennepin County.

As a longstanding advocate for the protection of private property from unconstitutional governmental intrusion, ALF filed an amicus brief arguing that a State may not circumvent the Just Compensation Clause by attempting to “redefine” private property as public property. The amicus brief was co -authored by Nancie Marzulla, a nationally recognized expert on Takings and related property law issues, and ALF Executive Vice President & General Counsel Larry Ebner.

On the Federalist Society webinar, Nancie noted that “the County is flat wrong on this point: property rights are not the creature of state law [but] are fundamental, inalienable rights that belong to every American.”
