Victory in New York Court of Appeals for Transparency in Government

In a landmark 6-0 ruling, the New York Court of Appeals (the states highest court) decided yesterday that the names of state and local government retirees receiving pensions are subject to public disclosure under the state Freedom of Information Law.

The case, In the Matter of Empire Center for New York State Public Policy v. New York State Teachers Retirement System, is described in our February 27, 2014, website posting.

The Court of Appeals agreed with Empire Centers contention that New York law did not allow two very large teacher pension funds to keep secret the names of pension recipients.

Atlantic Legal had filed an amicus brief on behalf of the Citizens Budget Commission and the Citizens Union of New York City in support of Empire Center.
